By accessing or using TiltFree, you confirm that you:

• Are at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Agree to comply with these Terms and all applicable laws and regulations

If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

TiltFree is a poker mental game companion application designed to help players:

• Track and manage emotional states during poker sessions
• Set and monitor personal commitments and session intentions
• Identify and respond to tilt patterns
• Reflect on sessions and track mental game progress

3. User Responsibilities

3.1 Account and Data

You are responsible for:

• Maintaining the security of your device and any data stored within the App
• All activities that occur under your use of the App
• The accuracy of information you input into the App
• Creating regular backups of your data if desired

3.2 Acceptable Use

You agree NOT to:

• Use the App for any unlawful purpose or in violation of any laws
• Reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to the App's systems or networks
• Distribute, license, or sell the App or any portion thereof
• Remove or alter any proprietary notices, labels, or marks
• Use the App in any manner that could damage, disable, or impair the Service

4. Intellectual Property

4.1 Our Rights

TiltFree, including its original content, features, functionality, design, and branding, is owned by TiltFree and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. The App's source code, graphics, user interface, and all related intellectual property remain our exclusive property.

4.2 Your Content

You retain ownership of all data and content you create within the App (session notes, reflections, commitments, etc.). By using the App, you grant us a limited license to store and process this content solely for the purpose of providing the Service to you.

4.3 Feedback

If you provide us with feedback, suggestions, or ideas about the App, you grant us the right to use such feedback without restriction or compensation to you.

5. Disclaimers

5.1 No Guarantees

TiltFree is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of any information obtained through the App

5.2 Poker and Financial Outcomes

We make no representations or guarantees that using TiltFree will:

• Improve your poker results or profitability
• Eliminate tilt or emotional reactions
• Lead to any specific financial outcome

Poker involves inherent risk and variance. Your results depend on many factors beyond mental game management.

5.3 Not Professional Advice

Content and features within TiltFree are for informational and self-improvement purposes only. The App does not provide:

• Medical or mental health diagnosis or treatment
• Professional psychological counseling
• Gambling addiction therapy
• Financial or investment advice

6. Limitation of Liability

To the maximum extent permitted by applicable law, TiltFree and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or goodwill
• Any gambling losses or financial damages
• Any damages resulting from your use of or inability to use the App

In no event shall our total liability exceed the amount you paid for the App in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.

7. Indemnification

You agree to indemnify, defend, and hold harmless TiltFree and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or transmit through the App

8. Modifications to Service

We reserve the right to:

• Modify, suspend, or discontinue the App (or any part thereof) at any time
• Add or remove features without prior notice
• Update pricing for premium features with reasonable notice

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

9. Termination

You may stop using the App at any time by uninstalling it from your device. We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the App ceases immediately
• Locally stored data remains on your device until you delete it
• Provisions of these Terms that should survive termination will remain in effect

10. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through:

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TiltFree regarding your use of the App and supersede any prior agreements.
